Electricity Distribution License – Irregular Transactions for Free Consumers
At the beginning of March, we read on some websites that a company with a distribution license attempted to cut the electricity of free consumers who are customers of these supplier companies on the grounds that some free consumers within their mandate "do not pay the System usage fee, which their suppliers must pay to the distribution company".
This practice is not only a place in any laws and regulations in this sector, but also acceptable within the framework of general law rules.
"Communiqué on Connection and System Use to Transmission and Distribution Systems in the Electricity Market", published in the Official Gazette no. 27.03.2003 and numbered 25601 of the Electricity Market Regulatory Authority, ¹ and 12.11.2008 date and 12.11.2008 Published in the Official Gazette no. 27052 and enacted in the "COMMUNICATION AND DISTING SYSTEMS IN THE ELECTRICITY MARKETS AND THE USE OF SYSTEMS TO MAKE CHANGES IN THE COMMUNICATION AND SYSTEM USE"²
When these communiqués are examined (²) Article 1. "10. Distribution system user: Consumers who have connected to the distribution system and legal entities operating in production using the distribution system, wholesale companies, OSBs and retail companies," The distribution system user's description is given.
In the last section of the epdk's table below, it is clearly stated who will make the payments to whom due to the parties to the Agreement and the use of the system.

Electricity Distribution License
In addition, this debt/credit relationship arises between the legal entity with the distribution system license and the distribution system user by signing the Distribution System Usage agreement and the use of electrical energy by the Free consumer who is the customer of the Relevant Distribution System User.
No section up to this point has a direct agreement and debt/credit relationship between the Distribution System licensee and the free consumer, and the entire relationship is between the Distribution system licensee and the distribution system user.
But can the legal entity with the distribution system license power the free consumer? He comes up with a question, you can only cut in the formation of the following conditions,
- If the customer uses illegal/irregular electricity,
- At the request of the supplier
- If the free consumer does not pay the company with the Distribution license of the reactive fee accrued in the term invoice
- In the absence of a follow-up to the internal installation regulations of the free consumer's measuring circuit,
Unless the above conditions occur, there is no point in cutting off the consumer's electricity due to a debt/credit relationship arising from the supplier of the Consumer's Electricity Distribution License.
Wouldn't it be a strange practice for the shipper to loot your shop if the wholesaler paid for the shipper's purchase after the delivery of a product that you bought from a wholesaler on the condition of address delivery?
Other than that, the work done is purely the use of disproportionate force against the consumer using public power.
The company's official, who owns the distribution license, said in a statement on the news above that the word "We distribute the Electricity of the State" is used. It's all false information. The state only generates its own electricity through distribution companies and its own personnel that have not been transferred to the private sector.
In addition, the production and distribution of electricity by the private sector is implemented within the framework of the law. If the private sector's electricity generation and wholesale is a crime, interested parties can legally search for their rights.
We don't know how many customers have lost power or been victimized, but one thing we do know is that we're not going to be able to do anything about it. such practices are completely contrary to the issues of electricity generation and market release and competition protection as stated in the Energy strategy document prepared by the Ministry of Energy.
